Legal Authority to Collect Information

Our collection, use, and disclosure of information for Marketplace assistance are governed by applicable law and Exchange standards, including Virginia Code § 38.2-6509 and the privacy and security standards referenced in Virginia’s Insurance Marketplace sample privacy notice, including 45 CFR §§ 155.220 and 155.260. Akins Advisory Partners LLC is a private insurance agency, not a government agency.

Contact and Quiz Inquiries

We use the details you submit to respond to your inquiry and discuss coverage options. Formspree processes contact and quiz submissions. Providing information is voluntary; required fields are needed to process your inquiry.

Please do not include Social Security numbers, medical records, financial documents, or other sensitive information in public inquiry fields. Sending a form requests a response; it does not authorize access to or submission of a Marketplace application. Any required application-assistance consent is documented separately. Text-message consent, where offered, is optional.

What Information Do We Collect?

When you submit an inquiry, we collect the details you choose to provide to respond to your request. Before providing Marketplace application or enrollment assistance, we obtain and document the required consent separately. An inquiry submission, quiz response, privacy acknowledgement, or text-message opt-in is not authorization to access or submit a Marketplace application. You may withdraw or limit your application-assistance consent at any time.

• Record of disclosures: You may request a record of when and with whom we have disclosed your information. Contact us using the information below.

We will not use your information for any unrelated purpose without your explicit consent.

Do We Share Your Information?

Website Services and Analytics

Contact and quiz submissions are processed through Formspree and may generate email notifications to our agency. The separate health-plan intake uses Google Forms. Google reCAPTCHA helps protect website forms from abuse. Google Analytics and Google Tag Manager measure website visits and interactions using cookies and similar technologies. These providers process data under their own applicable terms and privacy policies; see Google’s Privacy Policy and Formspree’s Privacy Policy.

Our custom successful-submission event includes the form category, form identifier, and page path, rather than the contents you enter. Do not place personal or health information in website URLs or public inquiry fields. Browser privacy controls can limit cookies and tracking; Google also provides an Analytics opt-out browser add-on.

How Do We Protect Your Information?

We use safeguards intended to protect information, including:

• Secure storage and transmission of data
• Limiting access to authorized personnel only
• Complying with federal and state privacy laws

Please avoid sending sensitive information via email, as email communication may not always be secure.

Is Providing Information Voluntary or Mandatory?

Providing information is generally voluntary; however, some data elements are required by law or by participating insurers to submit an application and enroll in coverage.

• Voluntary information (examples): optional contact preferences and other details that help us better assist you.

Effects of non-disclosure: If you choose not to provide required information, we may be unable to complete your insurance application or facilitate enrollment through the Exchange.

Changes to This Privacy Policy

We review this Privacy Policy at least annually and update it as needed to reflect changes in our practices or legal requirements. The latest version will always be available on our website.

Record Retention

As required by the Exchange, we maintain records of your consent and of application review/attestations for a minimum of ten (10) years and will provide them to the Exchange upon request.
